§ 202.06. SEPARABILITY.

  • The sections, paragraphs, sentences, clauses and phrases of these Codified Ordinances are separable. If any such phrase, clause, sentence, paragraph or section is declared to be unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs or sections of these Codified Ordinances, since the same would have been enacted by Council without the incorporation into these Codified Ordinances of any such unconstitutional phrase, clause, sentence, paragraph or section.
    If any provision of these Codified Ordinances or the application thereof to any person, fact, situation or circumstance is held to be invalid, the remainder of these Codified Ordinances and the application of such provision to other persons, facts, situations or circumstances shall not be affected thereby.
